Enforcement of the U.S. Foreign
Corrupt Practices Act has dramatically increased in recent
years. This seemingly simple statute prohibiting the payment
of bribes to foreign officials can be daunting when
one is confronted with the realities associated with
conducting business in many parts of the world. Similarly, the FCPA’s other component, the
accounting and recording-keeping provisions, is tied to
Sarbanes-Oxley and directly impacts all aspects of the
operations of publicly-held companies. To comply with the
far-reaching terms of the FCPA and yet compete in foreign markets can
be difficult and pose a formidable
challenge. As most developed countries have adopted and begun
to enforce their own version of
the Foreign Corrupt Practices Act, determining how to comply
with these anti-bribery statutes has
become essential to doing business abroad.
